STORM SANDY INSURANCE CLAIM DISPUTE RESOLUTION

After Storm Sandy hit the New York City area at the end of October 2012 and caused massive destruction, insured homeowners and business owners filed claims with their insurance carriers. Many were not happy with the carriers’ responses. As a response to their problems and  devastation suffered, New York’s Governor Andrew Cuomo established a program designed to help those whose claims were denied or, in their eyes, underpaid.

That response was a large mediation program administered by the American Arbitration Association and paid for by the insurance companies. It called on the services of almost 150 trained mediators who were given a crash course in disaster mediation (utilized for Hurricanes Katrina and Rita) and insurance law. Nancy Kramer was one of the earliest and eventually one of the busiest of those mediators and she will present a synopsis of the mediation program and of her experience. She will be joined in a panel discussion by three other Storm Sandy mediators, Robin Gise, Charles Newman and Irene Warshauer. 

Nancy Kramer is a mediator (over 500 mediations to date) and occasional arbitrator with a general practice who handles workplace, family, commercial, co-op/condominium and personal injury disputes.  She does private mediations, serves as Special Master in the Appellate Division, First Department and is on the arbitration panel for the Financial Industry Regulatory Authority (FINRA).  Nancy also mediates for the American Arbitration Association (AAA), New Jersey Superior Court;  New York County Supreme Court, Commercial Division and United States Postal Service. Before opening her dispute resolution practice, she had a long legal career in the public sector.  A graduate of Columbia University Law School and Brandeis University, Nancy presents or teaches about mediation frequently, for the American Arbitration Association, American Bar Association, Brooklyn Bar Association, Council of New York Co-operatives & Condominiums, New York City Bar Association, New York Corporation Counsel, New York State Attorney General's Office, New York State Bar Association, Practicing Law Institute and Touro Law School. Charles M. (Chuck) Newman is a mediator, lawyer and arbitrator concentrating in a wide range of commercial, family and divorce matters.  Practicing privately, he also serves as a mediator for the New York State Supreme Court Commercial Division and for the United States District Court, each in Manhattan.  He is a member of the Board of Directors of the Association for Conflict Resolution, Greater New York Chapter, and of the Board of Directors of the New York State Council on Divorce Mediation.  He is a co-editor of NYSCDM’s quarterly journal, The Report.  Among other bar and mediation committee service, he is a member of the New York City Bar Association’s Alternative Dispute Resolution Committee, and of committees of the New York State Bar Association’s Section on Dispute Resolution and Section on Commercial and Federal Litigation.  Chuck has been a coach or judge in numerous mediation and negotiation competitions, trainings, and continuing education programs at the graduate school, law school and professional levels.  He volunteers at the Community Dispute Resolution Center for Staten Island, the New York Center for Interpersonal Development (NYCID).  Chuck is a graduate of Lehigh University (magna cum laude) and of the New York University School of Law, where he was awarded an Arthur Garfield Hays Civil Liberties Fellowship.  Practicing from his midtown Manhattan office, he handles matters throughout the metropolitan area.


Irene C. Warshauer serves frequently as an arbitrator and mediator on commercial, employment, securities, tort and product liability matters for several leading dispute resolution institutions including the American Arbitration Association (AAA), International Centre for Dispute Resolution (ICDR), International Institute for Conflict Prevention and Resolution (CPR) National Panel of Distirnguished Neutrals, as well as CPR's Commercial, Franchise, E-discovery and mediation panels and FINRA. Mrs. Warshauer serves on the mediation panels of the federal, state and bankruptcy courts in New York and the New Jersey Superior Court. 

She is certified as a mediator by the International Mediation Institute, a fellow of the College of Commercial Arbitrators and a member of the National Academy of  Distinguished Neutrals. She has served as arbitrator, panel chair or panel member in more than 100 complex disputes and as as a mediator in more than 200 matters. Cases involved contract interpretation, securities, banking and financing transactions, employment, franchise agreements, insurance, environment, real estate, and a class action involving government entitites. She was just appointed a Sandy Voluntary ADR Mediator.

 

 Robin H. Gise, Esq., a mediator and arbitrator since 2009, has been involved in resolving numerous disputes concerning commercial, employment, insurance, construction and other issues.  She has a private ADR practice, and she co-mediates and assists in mediations with neutrals at JAMS.  Ms. Gise is a member of various mediation and arbitration panels, including the American Arbitration Association and the New York City Office of Collective Bargaining.

Ms. Gise serves as a mediation trainer for the New York City Bar Association’s Advanced Commercial Mediation Training and the Southern District of New York’s Employment Mediation Program.  Prior to becoming a neutral, Ms. Gise was an attorney at Cohen, Weiss and Simon LLP and Kaiser, Saurborn & Mair, P.C., with extensive litigation experience including trials, arbitrations and motion practice.  She graduated from Oberlin College and obtained her law degree from Fordham University School of Law.
